REPAIRMARKT TERMS AND CONDITIONS FOR CUSTOMERS

These Terms and Conditions govern the relationship between RepairMarkt and its customers regarding repair services, warranties, payments, and the use of our services. By using our services, you agree to be bound by the following terms:

1. General Terms
1.1. Service Agreement: By leaving your device with RepairMarkt for repair, you agree to the terms stated here and authorize RepairMarkt to perform the requested repairs on your device.

1.2. Device Ownership: You confirm that you are the owner of the device, or have full authority to authorize repairs. RepairMarkt is not liable for any claims related to ownership disputes. 1.3. Right to Refuse Service: RepairMarkt reserves the right to refuse service to any customer, particularly in cases of suspected tampering, improper use, or abuse of the device.

2. Diagnosis and Repair Process
2.1. Diagnosis Fee: RepairMarkt may charge a non-refundable diagnostic fee. This fee will be communicated to you prior to initiating any diagnostic service and may be deducted from the final repair cost if you proceed with the repair.

2.2. Approval for Repairs: No repair will be undertaken without your explicit approval. If additional repairs are required beyond the initial estimate, we will seek your consent before proceeding.

2.3. Repair Time: RepairMarkt will provide an estimated time for the repair. However, this is only an estimate, and actual repair times may vary due to parts availability, complexity, or unforeseen circumstances.

2.4. Parts Availability: If parts required for your repair are unavailable, RepairMarkt may use equivalent refurbished parts or offer alternative solutions after consulting with you.

2.5. Data Loss: RepairMarkt is not responsible for any data loss during the repair process. Customers are strongly encouraged to back up all data prior to submitting their device for service.

3. Warranty and Liability

3.1. Repair Warranty: All repairs* come with a 90-day limited warranty, covering only the specific repair performed. If the same issue reoccurs within 90 days, RepairMarkt will repair it again free of charge. *Water damaged Repairs are not covered.

3.2. Parts Warranty: Parts used in repairs may come with their own manufacturer warranty. If a part fails due to manufacturing defects within 90 days, it will be replaced at no cost to you.

3.3. Warranty Exclusions: The warranty does not cover new damages unrelated to the original repair. Issues resulting from misuse, accidents, modifications, or unauthorized repairs. Software issues or viruses.

3.4. Limit of Liability: RepairMarkt is not liable for any indirect, incidental, or consequential damages resulting from repairs, including but not limited to loss of data, revenue, or device functionality. Liability is strictly limited to the value of the repair service provided.

4. Payment Terms

4.1. Payment Due: Payment is due in full at the time of device collection, unless otherwise agreed in writing. RepairMarkt accepts payments via cash, credit/debit cards, and mobile money payments.

4.2. Estimates: Any estimates provided for repairs are subject to change based on the actual condition of the device or discovery of additional issues. We will notify you of any changes in cost before proceeding with further repairs.

4.3. Uncollected Devices: If you do not collect your device and pay for completed services within 30 days of being notified, RepairMarkt reserves the right to retain and dispose of your device to recover costs.

5. Returns and Refunds

5.1. Refunds on Services: If you are not satisfied with the repair service provided and the same issue persists after two repair attempts, you may request a full or partial refund. Refunds are processed at RepairMarkt’s discretion based on individual circumstances.

5.2. Returns on Products: Products purchased from RepairMarkt (such as accessories) can be returned within 14 days of purchase if unused and in original packaging, with proof of purchase. Refunds will be issued in the same form of payment as the original purchase.

5.3. No Refunds for Diagnostic Fees: Diagnostic fees are non-refundable, even if you decide not to proceed with the repair after the diagnosis.

6. Data Privacy and Security

6.1. Customer Data: RepairMarkt values your privacy. We will not access, copy, or share any personal data from your device unless necessary for the repair process and with your permission.

6.2. Data Backup: You are responsible for backing up any data on your device before submitting it for repair. RepairMarkt will not be liable for data loss under any circumstances.

6.3. Data Protection: RepairMarkt complies with applicable data protection laws and will take reasonable measures to ensure that any personal information you provide remains secure and confidential.

7. Abandoned Devices

7.1. Unclaimed Devices: Devices not claimed within 90 days after repair completion will be considered abandoned. After reasonable attempts to contact you, RepairMarkt reserves the right to dispose of or recycle abandoned devices. 7.2. Recovery of Costs: If a device is abandoned, RepairMarkt reserves the right to sell or dispose of it to recover any outstanding fees owed for services provided.

8. Limitation of Liability

8.1. Device Condition: RepairMarkt is not responsible for any existing damage to your device that was not caused by our repair process. We will document any visible damage when the device is submitted for repair. 8.2. Unexpected Damage: While RepairMarkt takes all necessary precautions, repairs carry a risk of further damage to the device due to its pre existing condition or complexity. In the event of irreparable damage, RepairMarkt’s liabilitywill be limited to the repair fee or the cost of a replacement device at our discretion.

9. Dispute Resolution

9.1. Governing Law: These Terms and Conditions are governed by the laws of the country in which the service was provided.

9.2. Dispute Resolution: Any disputes arising under these Terms and Conditions will be resolved amicably through negotiation. If the dispute cannot be resolved, it may be submitted to mediation or arbitration before pursuing any legal action.

10. Changes to Terms and Conditions

10.1. Policy Updates: RepairMarkt reserves the right to update these Terms and Conditions at any time. The most recent version will always be available on our website and in-store. 10.2. Effective Date: Any changes to the Terms and Conditions will be effective immediately upon
posting.

By submitting your device for repair at RepairMarkt, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
